This management position supervises attorneys and paralegals who provide legal representation and assistance to insureds as well as the Exchange. This position may include the supervision of attorneys and paralegals in the Subrogation Legal section which files and serves subrogation actions on behalf of the Exchange. This position ensures that legal representation is properly carried out within policy terms, is in compliance with statutory and regulatory requirements, and is in adherence with legal defense Best Practices. The primary functions include coaching, performance counseling, training of attorneys and paralegals, as well as regular communication, advice, and legal support to the Claims Business Unit.
Provides legal representation to insureds and the Exchange before courts, arbitration panels and alternative dispute forums relating to the defense of personal injury and possibly homeowner liability lawsuits. Individual case load may also include first-party claims (UM/UIM) and pre-litigation assignments.
Essential Job Functions:
Supervision of others includes but is not limited to coaching, mentoring, and supervising attorneys and paralegals. The Supervising Attorney will report to and assist Managing Attorney with the responsibility of reviewing and assigning new files as well as administrative functions. Coaching, mentoring and training includes but is not limited to:
Review of new file assignments and assignment of files to handling attorneys.
Participation in monthly file reviews with Claims Department personnel including recommendations on file handling.
Auditing of files for each assigned attorney as deemed necessary.
Review of assigned attorneys’ achievement of departmental goals related to litigation functions and performance.
Meetings with assigned attorneys discussing cases of concern, case evaluations and upcoming trials.
Review of all pre-trial reports with assigned attorneys.
Display exemplary conduct and performance for others in office.
Manage employees’ compliance with Club policies and federal and state labor and employment laws.
Coach and monitor Attorneys’ performance for timely and quality reporting.
Ensure Attorneys’ possess and gain necessary trial and discovery skills.
Education:
Requires law degree from ABA-approved law school and admission to the California Bar
Experience:
Preferred 10-15 years of insurance defense experience
Preferred 5-10 years of experience as primary attorney defending Attorney III-level cases [cases involving surgery, injections, brain injuries, significant fractures, punitive damages with serious injury and/or excess exposure)
Previous supervision of attorneys and staff a plus
Applicant must have excellent writing, oral, and case management skills.
