Overview: Marathon Asset Management is dedicated to delivering attractive absolute returns through investments in the global credit markets and real estate related markets. We are currently seeking an attorney with 3-6 years experience to primarily support Marathon’s market leading investment team that specializes in originating and purchasing loans secured by all types of commercial real estate properties, and secondarily support Marathon’s market leading investment teams that specialize in other asset based finance and investment strategies, including aviation, shipping, receivables, structured products, and other assets.Responsibilities:

  • Junior to mid-level attorney with 3-6 years’ experience in relevant areas; attorneys with significantly more experience will not be considered
  • Primary responsibility to provide legal support for all aspects of Marathon’s U.S. commercial real estate platform; preference will be given to candidates that have requisite experience to provide backup support for Marathon’s other asset based finance and investment teams, including aircraft, shipping structured products and other assets
  • Provide legal and structuring advice; review, draft and/or negotiate documentation with respect to all U.S. commercial real transactions, including loan documents, term sheets, non-disclosure agreements, engagement letters and other related documentation
  • Provide meaningful legal support and guidance in connection with all asset management matters, including review of leases, SNDAs, contracts, management agreements and future funding draw requests
  • Direct involvement in, and primary legal support for, the negotiation and closing of warehouse financing facilities and the securitization of portfolio loans; direct support and assistance for Marathon’s existing CRE CLO and warehouse lines of credit
  • Direct involvement in, and legal support for, all real estate loan workouts, restructurings, forbearances, foreclosures and portfolio related litigation matters
  • Coordinate with operations and tax teams on the development and structuring of current and potential new commercial real estate initiatives
  • Advise on legal, regulatory and reputational issues and risks arising on real estate transactions and work closely with the wider Marathon legal and compliance teams on fund legal matters
  • Coordinate and manage outside counsel, including management of legal costs; maintain relationships with outside counsel and oversee the internal approval of all legal counsel
Qualifications:
  • Juris Doctor degree (or equivalent), and membership in good standing of the New York State bar
  • 3-5 years’ progressive experience in commercial real estate finance, ideally with some in-house legal experience at a real estate fund or investment management fund that focuses on commercial real estate. Additional experience with other secured asset based finance areas (aircraft, shipping, residential mortgages and/or consumer loans) a plus but not required
  • Strong decision making and communication skills and relationship building qualities
  • Demonstrated ability to appropriately assess and manage legal and reputational risk and demonstrate sound judgment in the resolution of such matters
  • Ability to thrive in a fast-paced, dynamic, and demanding open-office environment (temporarily remote)
  • Ability to prioritize efficiently and manage a complex, time sensitive workload
  • Excellent attention to detail and accuracy
  • Willingness to learn new areas of law to cover other businesses and investment initiatives
  • Strong computer skills including Microsoft Word, Excel, PowerPoint and Outlook
