Under general supervision of the Program Coordinator (PC), the Tobacco Compliance Specialist (TCS), will conduct tobacco retailer inspections to measure compliance for tobacco minimum-age, marketing and advertising laws in conjunction with the Food and Drug Administration (FDA) contract and State Synar Amendment regulations which require states to have laws and enforcement programs for prohibiting the sale and distribution of tobacco to persons under 21. The TCS conducts all pre-screenings of areas selected for inspection to determine if safety issues are present and determines efficient travel routes to efficiently complete the compliance checks. The PSC then coordinates the schedules of their three-member inspection team. The TSC is responsible for the training of the Underage Participant (UP) on the compliance checks procedures; completes required paperwork for the UP’s participation; supervises/conducts the inspections; collects required data for the inspection form; and, submits data to their supervisor. The TCS will coordinate and conduct two types of tobacco compliance check inspections: (1) undercover buys to determine a retailer’s compliance with age and photo identification requirements; and (2) advertising and labeling, to cover ensure compliance with some provisions of the Tobacco Control Act. The TCS is responsible for conducting pre-screening activities; recruiting and training UPs -, engaged in the undercover buy inspections; reporting results, and maintaining and submitting evidence associated with the inspections. Federal Synar Regulations require all states to: annually evaluate retailer compliance to minimum-age tobacco laws; achieve a Retail Violation Rate (RVR) of 20 percent or less; demonstrate that minimum-age tobacco laws are reasonably enforced; and report these activities to the Center for Substance Abuse Prevention. Failure to achieve these regulations can result in a reduction of the state's Substance Abuse Prevention and Treatment Block Grant Funding. This PSC provides for the completion of the annual compliance checks to evaluate retailer compliance. To enhance state Synar efforts and enforce federal tobacco laws, the Commission is also contracted by the FDA to conduct tobacco retailer inspections that measure compliance to minimum-age tobacco, marketing and advertising laws. 1. Knowledge, skill and mental development equivalent to completion of four (4) years of college. 2. Two (2) years of experience working in a professional environment with experience conducting inspections, completing reports, training and communicating with the public. Compliance testing and law enforcement experience is preferred.
